Copyright

All photographs, films, and visual works published on this website — including those appearing in the portfolio, journal, and all social media channels — are the exclusive intellectual property of byduran (Diana Duran).

Copyright is retained by byduran at the moment of creation, in accordance with Indonesian copyright law (Law No. 28 of 2014 on Copyright), the Berne Convention, and applicable international intellectual property treaties.

No image may be reproduced, distributed, displayed, modified, or used in any form without prior written permission or an active license agreement. Watermark removal, screenshotting for reuse, or embedding without authorisation constitutes copyright infringement.

License Types

byduran offers image licenses for a range of purposes. Each license is non-exclusive unless otherwise agreed in writing. All licenses are granted for a specific use case, territory, and duration as defined at the time of agreement.

Pricing is determined by image, usage type, territory, duration, and exclusivity. Contact us to discuss your needs and receive a quote.

What Is Included in a License

Unless otherwise specified in writing, all image licenses include:

• A high-resolution digital file suitable for the agreed use
• A signed license agreement specifying use, territory, and duration
• Basic colour-grading and retouching as delivered

Licenses do not include:

• The right to modify, crop, or retouch the image beyond minor adjustments, without written approval
• Ownership or transfer of copyright
• The right to sublicense, resell, or redistribute the image to other parties
• Clearance of any third-party intellectual property that may appear incidentally in the frame (e.g. artwork, signage, branded products)

Restrictions

The following uses are expressly prohibited under all license tiers unless specifically negotiated in a separate written agreement:

• Use of images to train artificial intelligence, machine learning, or generative models of any kind
• Resale or sublicensing of images to stock agencies, image libraries, or third parties
• Use in political campaigns, propaganda, or content that promotes discrimination or harm
• Use in adult content or contexts that would bring the subject or photographer into disrepute
• Alteration of images in a way that misrepresents the original subject or intent
• Removal or obscuring of any embedded copyright metadata
• Use beyond the agreed territory, time period, or platform without renewal

Violation of these restrictions voids the license immediately and may result in an invoice for unlicensed usage fees at three times the standard commercial rate, plus legal costs.

Model & Location Releases

Model releases

All portraits and lifestyle images featuring identifiable individuals published on this site have been made with the subject's knowledge and consent. Signed model releases are held on file and available to licensees upon request for commercial use.

For images commissioned privately (portrait sessions, events), the client is responsible for ensuring that all participants have consented to the agreed usage. byduran does not publish commissioned portrait images without express client approval.

Location releases

For commercial licensing of images made on private property, byduran will advise whether a location release was obtained. Where no release is held, the licensee assumes responsibility for obtaining any necessary permissions before commercial use.

Minors

Images featuring individuals under 18 years of age are only published with written parental or guardian consent. These images are not available for commercial licensing without additional written consent from the parent or guardian.

Fine Art Prints

Selected images from the byduran portfolio are available as limited-edition fine art prints. Prints are produced on archival-quality fine art paper using pigment inks, signed and numbered by the photographer.

Edition sizes

• Limited editions are produced in runs of 10 or 25, depending on the image.
• Once an edition is sold out, no further prints are made of that image at that size.
• Each print comes with a certificate of authenticity signed by byduran.

Print usage rights

The purchase of a fine art print grants the buyer a personal use license — the right to display the print privately in a home or office. It does not transfer copyright, and the print may not be reproduced, photographed for commercial use, or resold as a print.

Client Sessions

Images produced during a commissioned session (portrait, lifestyle, event, or commercial) are delivered to the client under the terms agreed at booking. Standard terms are as follows unless a separate contract specifies otherwise:

Personal session deliverables

• Edited images are delivered for personal and social media use only.
• Commercial use (advertising, brand campaigns, press) requires a separate commercial license, agreed in advance.
• byduran retains the right to use session images in the portfolio, journal, and social media for self-promotion, unless a confidentiality clause is agreed at booking.

Commercial session deliverables

• Usage rights are defined in the project brief and confirmed in the booking agreement.
• Deliverables are licensed for the agreed platform, geography, and duration.
• Additional usage beyond the agreed scope requires a supplemental license fee.

Raw files

Raw (unedited) files are not included in any delivery and are not available for purchase. The edited, delivered images are the final product of the session.

Credit & Attribution

For editorial and personal use licenses, we request — but do not require — that images be credited as follows:

For commercial licenses, the credit requirement will be specified in the license agreement. Where a credit is contractually required and omitted, this constitutes a breach of the license terms.

Credit does not replace a license. An image used without permission is not made lawful by the addition of a credit line.

How to License an Image

To license an image from the byduran portfolio:

1. Identify the image you wish to license (a URL or description is helpful).
2. Describe your intended use: platform, geography, duration, audience size, and whether the use is commercial or editorial.
3. Contact us at hello@byduran.co or via the contact form.
4. We will confirm availability, provide a quote, and issue a license agreement if we proceed.
5. The license is granted upon receipt of payment and a signed agreement.

We aim to respond to all licensing enquiries within 3 business days. Rush licensing is available for time-sensitive projects.
